1. General
These General Terms and Conditions from Mixguru apply to all contracts that the provider concludes with its contractual partners. The inclusion of the buyer’s own terms and conditions is hereby expressly rejected, unless something different is agreed separately in writing between the parties in individual cases.
2. Conclusion of contract
The contract is concluded by the customer accepting the offer from Mixguru, which is detailed overleaf and tailored to the customer’s individual needs. The customer can only accept the offer in writing or by email.
3. Subject of the contract
The subject of the contract is the preparation and serving of drinks and snacks. The scope of services is based on those specified overleaf and on the individual needs and specifications of the customer.
This also applies to the place and time of the service, which are also determined according to the customer’s wishes. Any additional services subsequently requested by the customer that go beyond the offer will be provided by Miuxguru as far as possible against separate billing by agreement.
The customer warrants that he has available suitable terrain for his event in accordance with the specifications in the offer, in particular with regard to minimum size, load capacity and level or slope, which can be accessed directly with delivery trucks on permitted terrain.
The stated logistics costs include delivery to the curb. If the event location is located higher up/cannot be reached by a [freight] elevator, it is the client’s responsibility to provide staff for the contract.
If this additional effort is assigned to Mixguru, €79 per contract will be invoiced; This also applies to renovation work during the event.
The customer is aware that the drinks may be prepared using electricity and that the hygiene compliance measures at the mobile counter are carried out using tap water in accordance with the German Drinking Water Ordinance and guarantees this

4. Prices and payment terms
The prices stated by Mixguru are net prices, i.e. they include all price components, plus the statutory German sales tax. Any additional costs that may arise. e.g. B. in particular for travel, overnight stays for staff on site, etc., are stated separately and can be seen in the offer for the customer.
5. Cancellation
The contract can be terminated by the customer up to 30 calendar days before the service date for a fee of 25% of the agreed price. Less than 30 days for a fee of 50% and if canceled less than 7 calendar days before the service date, 75% of the agreed price or expected sales will be due.
6. Insurance and permits; third party fees; Licenses
As the organizer, the customer is solely responsible for ensuring that the event is adequately insured and therefore, if necessary, takes out organizer liability insurance with sufficient coverage at his own expense and responsibility. If the customer has not taken out adequate insurance cover, he will release Mixguru from any claims for damages etc. in the event of damage, provided that the damage is one that would typically have been covered by the event organizer’s liability insurance.
The customer also obtains, on his own responsibility and at his own expense, any necessary third-party permits, in particular from authorities, which are required for the implementation of the event, including music law permits (e.g. GEMA).
7. Damages
Items damaged by the customer or their guests may be charged to the customer.
8. Complaints
Customer complaints can only be made and acknowledged during the event. At Mixguru’s discretion, justified complaints can be settled through repairs, replacement delivery or compensation.
9. Disposal
Unless otherwise agreed, it is agreed that the waste generated will remain on site and be disposed of by the client.
10. Severability clause
If one of the agreement points of this order is invalid in the sense of the offer, this does not affect the order as such.
In this case, both contracting parties undertake to formulate an agreement that comes closest to the spirit of this agreement.
